Terms and conditions for Advertisers
These Terms and Conditions form part of the Agreement between the Customer and Browns Consulting Ltd trading as Finance Jobs Now (Company Number 9389996).
1. Definitions
“The Website” means Finance Jobs Now www.financejobsnow.co.uk
“Customer” means any person or business who uses the services offered by Finance Jobs Now
“Jobseeker” means an individual who is looking for a job, applying for a job vacancy or creating an account with personal details via the website
“Candidate” means “Jobseeker” as defined in these Terms and Conditions
“Services” means job listing, CV Search or any other product or service offered by Finance Jobs Now
“Job Listing” means advertising space provided on the website to customers to advertise current job vacancy to jobseekers
“Recruiters” means any person or business seeking to recruit a jobseeker to a vacancy
“CV Search” means search of CV database owned by Finance Jobs Now
“Vacancy” means a job advertised in a job listing
All references to “our”, “us” or “we” within these Terms and Conditions are deemed to refer to Finance Jobs Now.
2. Services
Finance Jobs Now acts as an online job site providing recruiters space on the website to list their job vacancies.
Details of all current services offered by Finance Jobs Now together with pricing are available on the Website and will be accepted by the customer at the time of purchase.
Finance Jobs Now does not act as a recruitment consultancy and does not charge any fee to either the jobseeker or recruiter if a jobseeker is recruited to a vacancy.
Finance Jobs Now is not party to any contract or agreement made between the jobseeker and the recruiter.
Finance Jobs Now does not guarantee that jobseekers will apply for any vacancy.
Jobseekers may apply for any vacancy on the website and Finance Jobs Now does not warrant or guarantee the suitability or integrity of any job seeker or job seeker application.
Finance Jobs Now reserves the right to remove or amend services provided at any time.
3. Price and Payment
All prices charged and paid are confidential between Finance Jobs Now and the Customer.
The Customer agrees not to disclose prices paid for job listings, CV searches or other services provided by Finance Jobs Now to third parties.
Any payment due for services ordered is required before service commences.
Current prices are available on the website. Finance Jobs Now reserves the right to amend these prices at any time.
4. Customer Obligations
The Customer agrees to adhere to the rules of Job Listings in section 5.
The Customer agrees to adhere to the rules of CV Search Service in section 6.
The Customer is responsible for the content of material supplied by them and for ensuring that they have the right to supply it and that it complies with all relevant legislation and codes of practice. If we receive complaints about any material or its content we may, at our discretion, remove the material from display without reference or liability to the Customer.
The customer agreed to indemnify us against any claim that the material infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.
If the Customer is an employment agency or an employment business (as defined by the Employment Agencies Act 1973) it is their sole responsibility to ensure the advertisements they place on the website comply with the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
The Customer shall keep strictly confidential all information disclosed by the Jobseeker and act in accordance with the all applicable Data Protection Laws and the Employment Agencies Act 1973 (and all other relevant legislation and regulations made there under).
The Customer will act in a professional and courteous manner to all jobseekers.
The Customer shall not resell the Service purchased from Us to any third party. The Service is for use by the Customer only and allows exclusive access to the Service using unique user names and passwords in accordance with these Terms. If the Customer or any director, employee, agent or affiliate of the Customer is found to share user names and or passwords with any party who is not a Customer then such sharing will be a material breach of this Agreement.
The Customer accepts the following:
1. Finance Jobs Now does not act as a recruitment business and does not make introductions or recommendations of jobseekers to Customers
2. Any contact made between the Customer and the jobseeker is outside of this agreement and that Finance Jobs Now is not party to any agreement or contract made between the Customer and the Jobseeker
3. Finance Jobs Now does not guarantee that the customer will receive applications from jobseekers for vacancies in job listings
4. Finance Jobs Now does not guarantee that the Customer will find suitable candidates for vacancies if they use the CV Search service by accessing Finance Jobs Now CV Database
5. Rules for Job Listings
Customers must abide by the following rules for job listings:
1. Vacancies advertised in the job listings must be currently available
2. Information contained within the job listing must be accurate
3. Vacancies and Job Listings must be categorised accurately within the Finance Jobs Now job categories
4. No excessive or gratuitous use of keywords in job listing details is permitted
5. Job listings which discriminates on grounds of sex, race, age or disability is illegal and may result in proceedings being taken against the Customer
Any job listing added by a Customer in breach of these rules will be removed as soon as Finance Jobs Now becomes aware of the breach. In such circumstances, the Customer will not be entitled to a refund.
6. Rules of CV Search Service
Customers must abide by the following rules for CV Search Service:
1. The Customer may not contact the individuals on the CV Service other than for the purpose of finding suitable Candidates for specific current job vacancies
2. The Customer shall ensure that no automatic extraction software is used to facilitate the downloading or capturing of CVs from Our database
3. The Customer shall not resell CVs obtained from the website
4. The Customer agrees not to disclose any of the data from CV Service to any third party, unless Customer is an authorized recruitment agency or staffing agency and Customer is disclosing the data to an employer that has retained Customer's services to search for suitable candidates for a job vacancy
7. Finance Jobs Now Obligations
Finance Jobs Now will provide the Services with reasonable care and skill.
Finance Jobs Now will endeavour to maintain Services 24 hours per day, 365 days per year subject to periodic essential maintenance.
If the Website and/or Services are unavailable for any consecutive period of 48 hours due to our fault and with the exception of de-activated accounts due to breach of Customer's obligations, we shall extend the Term of the services by the period of such non-availability, without further payment from the Customer.
If for reasons beyond Our control We are unable to keep the Websites live or updated for a period of 5 working days or more, the Customer shall be entitled to a pro rata rebate of monies paid to Us.
8. Liabilities
We will not be liable for any costs, expenses or damages incurred by the Customer (the “Costs”) pursuant to the Services. Nothing in this paragraph shall limit or exclude any liability incurred by us due to fraudulent misrepresentation or concealment, nor for any damages for personal injuries caused by the negligence of the Customer, its agents or its employees.
9. Data Protection
The Customer must take all reasonable steps to protect the jobseeker personal data acquired via the website.
The Customer must comply with all current UK Data Protection Legislation.
The Customer must not sell or share jobseekers personal data or information with any third party without the prior consent of the jobseeker
Whilst Finance Jobs Now complies with all current UK Data Protection legislation, it cannot be held responsible for the data protection of information acquired by the customer. The Customer therefore accepts and agrees to indemnify Finance Jobs Now for any loss or damage caused by breach of UK Data Protection Legislation by the Customer, including costs incurred by Finance Jobs Now in defending any such claims.
Our Privacy Policy can be found on our website and by accepting these Terms and Conditions, you will be deemed to have read and accepted our Privacy Policy
10. Termination
The Customer may terminate in writing the provision of Services:
(i) by no less than 14 days;
(ii) if we are in material breach of these terms and conditions and have not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied; or
(iii) if we become insolvent, cease to trade or go into liquidation.
We may terminate the provision of Services if:
(i) the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied; or
(ii) the Customer becomes insolvent, ceases to trade or goes into liquidation.
11. 3rd Party Sites
The Customer acknowledges that the Website is publicly available on the internet and that any content, including content provided by the customer, can be copied from the Website without our permission by third party websites and that we have no control over such content or third party websites.
The customer accepts that job vacancies posted on this website may also appear on third party sites as part of agreements between Finance Jobs Now and third party websites.
12. General
No delay by us in enforcing any provision of this Agreement shall be construed as a waiver.
The Agreement is personal to the Customer and may not be assigned or transferred to any third party without the prior written consent of a Director of Browns Consulting Ltd
Each Term of this Agreement is severable and distinct from the others and, if any provision is, or at any time becomes to any extent or in any circumstances invalid, illegal or unenforceable for any reason, that provision shall to that extent be deemed not to form part of this Agreement but the validity, legality or enforceability of the remaining parts of this Agreement shall not be affected or impaired, it being our intention that every provision of this letter shall be and remain valid and enforceable to the fullest extent permitted by law.
We reserve the right to vary this Agreement from time to time. Such changes shall either be notified to you by email or posted on the Websites. Such changes shall be deemed to be accepted if you continue to use the Websites or Service after a period of one week from the date of transmission of the email or of posting on the Website, whichever occurs later.
Neither party shall be liable to the other, for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable control including without limitation any power failure.
13. Governing Law
This Agreement shall be governed and construed in accordance with English law and under the jurisdiction of the English courts.
